General Terms and Conditions for Room Bookings
1. Scope
These general terms and conditions for room bookings («GTC») apply to Nakorn River View Guesthouse, Restaurant & Café for the provision of hotel rooms/guest rooms for the accommodation of customers, as well as all other services and deliveries provided by the hotel/guesthouse in this context.
The customer’s general terms and conditions do not apply.
The General Terms and Conditions are also available in Lao and English. In the event of any discrepancies, the German version shall prevail.
2. Conclusion of contract
An individual reservation is valid until 4 p.m. on the day of arrival without a guarantee. With a room guarantee, your reservation remains valid for the entire night, even if you arrive after 4 p.m.
The following are considered guarantees for a room reservation:
- Credit card (Visa, Mastercard)
- Prepayment for one night, e.g. by bank or postal transfer
- Written guarantee from a bank registered in the commercial register, based in Lao PDR
An offer for group reservations is explicitly designated as such and must be signed by the customer and returned to the hotel. An offer is valid for 72 hours (acceptance period). This means in particular that offers, price lists and the like issued by a hotel do not constitute a binding offer.
Nakorn River View expressly reserves the right to put rooms back on sale during and after the acceptance period for the group reservation offer has expired. In the event of a new request, the new offer may contain differences from the first offer.
If a request comes from a customer and is confirmed by the hotel, then this confirmation constitutes acceptance of the contract by the hotel/guest house.
3. Services and Prices
The customer does not acquire any right to the provision of specific rooms, but the hotel/guesthouse undertakes to provide rooms of the reserved category. If, for unforeseen reasons, no room of the same standard as that reserved is available upon arrival, accommodation will be provided in a room of the next higher category. In the event that no room is available in the hotel/guesthouse, the hotel/guesthouse will arrange accommodation of at least the same standard in another hotel. The hotel/guesthouse will also cover the cost of transport there and back with luggage and a 3-minute international telephone call so that the new address can be communicated.
The customer is obliged to pay the applicable or agreed prices of the hotel/guest house for the room and the other services used by him. This also applies to services and expenses incurred by the Nakorn River Views for third parties at the customer's request.
Prices are in LAK, per room / night, including free WiFi, service and VAT. City tax per person / night, if applicable, is not included.
4. Room handover and return
Booked rooms are available to the customer from 2 p.m. on the agreed arrival day. The customer has no right to move into the room earlier.
On the agreed departure day, the rooms must be vacated and made available to the hotel/guest house by 12:00 noon at the latest. After that, the hotel/guest house can charge 50% of the full accommodation price (list price) for use of the room beyond the contractual time until 6:00 p.m., and 100% from 6:00 p.m. on wards.
Unless an individual agreement is made.
5. Payment
Hotel/guest house invoices without a due date are payable within 10 days of receipt of the invoice without deduction. The hotel/guest house is entitled to make accrued claims due at any time and to demand immediate payment.
The hotel/guest house is entitled to request an appropriate advance payment upon conclusion of the contract or thereafter.
or to demand security. The amount of the advance payment and the payment dates will be announced with the offer.
If the customer is resident abroad, the hotel/guest house reserves the right to debit the entire invoice amount from the guarantee credit card. Any exchange rate differences or bank charges are to be borne by the customer.
The customer can only offset a claim against a claim of the hotel/guest house if it is undisputed or legally binding.
6. Cancellation conditions
6.1 Cancellation conditions for individual reservations
Individual reservations are normally considered final when the Nakorn River View offer has been confirmed. In the event of a short-term cancellation after the cancellation period has expired, 100% of the overnight stay may be charged.
Cancellation policies may vary depending on the hotel/guesthouse and offer. However, certain rates have special conditions that make cancellation impossible. However, unless otherwise stated, the following conditions apply to individual reservations:
- Cancellation until 4 p.m. on the day before arrival: no costs
- Cancellation after 4 p.m. on the day of arrival: cost of one night
- Cancellation during the stay (multiple nights): cost of an additional night
6.2 Cancellation conditions for groups

7. Withdrawal of Nakorn River View Guesthouse, Restaurant & Café
If the customer has the right to cancel free of charge in accordance with the above paragraph 6 or a separate agreement, the hotel/guest house is entitled to withdraw from the contract during this period if other customers request the contractually booked rooms and the customer does not waive his right to cancel free of charge when asked by the hotel/guest house.
If an agreed advance payment is not made even after the expiry of a reasonable grace period set by the hotel/guest house, Nakorn River View is also entitled to withdraw from the contract.
Furthermore, the hotel/guest house is entitled to withdraw from the contract for objectively justified reasons, for example if
- force majeure or other circumstances beyond the control of the hotel/guest house make the fulfilment of the contract impossible
- Rooms are booked under misleading or false information regarding essential facts, e.g. the identity of the customer or the purpose
- the hotel/guest house has reasonable grounds to believe that the use of the hotel service may endanger the smooth running of the business, the security or the reputation of the hotel/guest house in the public eye, without this being attributable to the control or organizational sphere of Nakorn River View's
- there is a violation of paragraph 5 above.
If the hotel withdraws for legitimate reasons, the customer is not entitled to compensation.
8. Bookings through tour operators
When booking through a tour operator, the tour operator's general terms and conditions apply to the guest. These terms and conditions apply between the hotel and the tour operator.
9. Children's prices
A baby cot can be provided free of charge for children up to 2 years old upon request. Children up to the age of 6 can stay in their parents' bed free of charge. Children from 6 years to 12 years old can stay in an extra bed for an additional charge of LAK 220,000 per night. From 12 years old, the extra bed charge is LAK 220,000 per night.
10. Liability / Duty of Care
The customer must use the hotel room with the utmost care. The customer or the company must pay for any damage caused. The hotel/guest house accepts no liability for theft, etc. and in relation to services provided by third parties. In addition, the hotel/guest house is only liable for deliberate or grossly negligent contractual or non-contractual direct damage. Any further liability is excluded.

12 Final Provisions
In addition to the General Terms and Conditions, other provisions and booking conditions may apply which take precedence over the General Terms and Conditions. Changes or additions to the accepted offer or to these General Terms and Conditions must be made in writing. Unilateral changes or additions by the customer are invalid.
The place of performance and payment is the registered office of the hotel/guest house.
Laotian law applies and the exclusive place of jurisdiction is Vientiane.
Should individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. Otherwise, the statutory provisions shall apply.
Cancellation Policy Groups
definition of group booking
A group booking refers to a booking of at least 4 hotel rooms (with or without meals) made simultaneously by the same customer.
customer
The client is the person – legal or in person – who is responsible for paying the group. The client is also the same person who signs the contract.
booking
A booking can be made by telephone or in writing. The hotel must confirm a booking in writing for it to be valid. For booking values over USD 2,500 excluding VAT, the booking must be confirmed by the General Manager/Owner of the hotel/guesthouse.
Cancellations up to 12 rooms / 30 people
Cancellations must be made in writing and confirmed by the hotel or customer to be valid. The following cancellation policy applies:
No-shows (unused hotel room):
In case of no-shows, when a guest does not arrive as agreed, the entire stay will be charged. In case of early departures, when someone leaves earlier than agreed, the entire stay will be charged at the full price as agreed.

The list of names must be sent to the hotel in advance and at least 14 days before arrival.
payment
The customer is responsible for all costs incurred in the order. If participants are to pay for items separately, this must be approved by the hotel. Participants' failure to attend ordered meals or booked rooms does not entitle them to change prices.
Payment must be made as agreed. Nakorn River View only bills registered Lao companies after a standard credit check, as well as state and municipal entities.
Group arrangements must be paid at least 50% 4 weeks in advance, unless otherwise agreed, and paid in full before the check-in day.
If payment is not received by the payment date stated on the proforma invoice, we reserve the right to cancel your booking.
General Terms and Conditions Events
1. Scope
These general terms and conditions for events («GTC for events») apply to Nakorn River View Guesthouse, Restaurant & Cafe based in Baan Vatnakhone, in connection with the rental of seminar, banquet and event rooms ("Premises") as well as other related services or deliveries to and for the customer or event organizer. The subletting or further rental of the rooms or areas provided as well as the invitation to interviews, sales or similar events require the prior written consent of the hotel/guest house.
The organizer’s general terms and conditions do not apply.
The General Terms and Conditions are also available in Lao and English. In the event of any discrepancies, the German version shall prevail.
2. Reservations
An offer to rent out premises is explicitly designated as such and must be signed by the customer and returned to the hotel/guest house. An offer is valid for 7 days (acceptance period). This means in particular that offers, price lists and the like issued by a hotel/guest house do not constitute a binding offer. The hotel/guest house expressly reserves the right to put the premises back up for sale before, during and after the acceptance period for the offer has expired. If a new request is made, the new offer may contain deviations from the first offer.
If a request comes from a customer and is confirmed by the hotel, then this confirmation constitutes acceptance of the contract by the hotel/guest house.
3. Prices
The price lists are individual and subject to change. All prices are in Laotian Kip, net, including service and statutory VAT. The prices confirmed in writing by the hotel/guesthouse apply.
4. Payment
Hotel/guest house invoices without a due date are payable within 10 days of receipt of the invoice without deduction. The hotel/guest house is entitled to demand immediate payment of accrued claims at any time. The hotel/guest house is entitled to demand an appropriate advance payment or security upon conclusion of the contract or thereafter. The amount of the advance payment and the payment dates will be announced with the offer. If there are no separate advance payment conditions, the following rules apply:
- Advance payment up to 30 days before arrival 50% of the expected total turnover
- Advance payment up to 14 days before arrival 100% of the expected total turnover
If the organizer is based abroad, the hotel/guest house reserves the right to debit the entire invoice amount from the guarantee credit card or to request payment in full before the event. Any exchange rate differences or bank charges are borne by the organizer. The customer can only offset an undisputed or legally binding claim against a claim of the hotel/guest house.
5. Joint liability for payment
If the client is not also the organizer, he is jointly and severally liable with the organizer for the entire invoice amount. This liability also extends in cases where direct payment has been expressly agreed.
6. Cancellation conditions
Cancellations will only be accepted in writing. The hotel/guest house reserves the right to adapt the cancellation conditions individually depending on the type and size of the event and to integrate them into the offer/reservation confirmation.
If there are no separate cancellation conditions, the following rules apply:
- Cancellation free of charge up to 60 days before arrival
- Cancellation up to 30 days before arrival 50% of the expected total turnover
- Cancellation up to 14 days before arrival 100% of the expected total turnover
Deviations of up to 10% of the number of participants can be reported up to 48 hours before the event and are binding. If the actual number of people on the day of the event is smaller, the definitely confirmed number will be used as the basis for billing. The additional costs incurred by the additional participants will be invoiced. The maximum room capacities set by the fire department must not be exceeded.
7. Withdrawal of Nakorn River View Guesthouse, Restaurant & Café
If the customer has the right to cancel free of charge in accordance with the above paragraph 6 or a separate agreement, the hotel/guest house is entitled to withdraw from the contract during this period if other customers request the contractually booked rooms and the customer does not waive his right to cancel free of charge when asked by the hotel/guest house.
If an agreed advance payment is not made even after the expiry of a reasonable grace period set by the hotel/guest house, the hotel/guest house is also entitled to withdraw from the contract.
Furthermore, the hotel/guest house is entitled to withdraw from the contract for objectively justified reasons, for example if
- force majeure or other circumstances beyond the control of the hotel/guest house make the fulfilment of the contract impossible
- Rooms are booked under misleading or false information regarding essential facts, e.g. the identity of the customer or the purpose
- the hotel/guest house has reasonable grounds to believe that the use of the hotel service may endanger the smooth running of the business, the security or the reputation of the hotel/guest house in the public eye, without this being attributable to the control or organizational sphere of Nakorn River Views
- there is a violation of the above paragraph 4
- a violation of paragraph 8 below
In the event of justified withdrawal by the hotel/guest house, the customer shall not be entitled to any compensation.
8. Detailed information / procedure
An appointment must be made in advance to discuss the details. To ensure that the event runs smoothly, all important information (e.g. equipment, menu selection, schedule, show acts, etc.) must be communicated to the hotel/guest house at least 10 days before the event. The agreed program times must be strictly adhered to by both parties.
9. Use of space
In exceptional cases, the hotel/guest house is entitled to make room changes at short notice for events without prior notice. In any case, the hotel/guest house reserves the right to provide a room appropriate to the number of participants and the occasion if the number of people is reduced. Reception tables, advertising material, banners, etc. may only be set up outside of the rented rooms in consultation with Nakorn River View. Public areas of the hotel/guest house may not be used for group work. This must take place in the agreed group rooms. Smoking is prohibited in all areas of the hotel/guest house.
10. Menu adjustments
The hotel/guest house reserves the right to make menu adjustments and changes in wine vintages.
11. Corkage fee
The event organizer and his guests are not allowed to bring their own food and drinks to events. Exceptions require a written agreement with the hotel/guest house. If you bring your own wine, spirits, cakes, etc., a corkage fee to cover overhead costs will be charged along with the total amount.
12. Decoration / Flowers
The installation of decorations or other objects requires approval, including for fire safety reasons. Any damage caused during mooring etc. will be invoiced to the organizer.
13. Parking
Parking is usually available in or near the hotel/guest house. Unless otherwise agreed, the organizer or the individual participants will bear the applicable parking fees.
14. Technical facilities and connections
If the hotel/guest house procures technical and other equipment from third parties for the organizer at the organizer's request, it does so in the name, on behalf of and at the expense of the organizer. The organizer is liable for careful handling and proper return. It releases the hotel/guest house from all claims by third parties arising from the provision of these facilities.
The use of the organizer's own electrical equipment using the Nakorn River Views' power grid requires the organizer's written consent. Any malfunctions or damage to the hotel/guesthouse's technical equipment caused by the use of these devices are the responsibility of the organizer, unless the hotel/guesthouse is responsible for them. The hotel/guesthouse may record and charge a flat rate for the electricity costs incurred through use.
With the consent of the hotel/guest house, the organizer is entitled to use his own telephone, fax and data transmission facilities. The hotel/guest house may charge a connection fee for this.
If suitable facilities in the hotel/guest house remain unused due to the organizer connecting his own facilities, a compensation fee may be charged.
Malfunctions in technical or other facilities provided by the hotel/guest house will be remedied immediately if possible. Payments cannot be withheld or reduced if the hotel/guest house is not responsible for these malfunctions.
Small adjustments can be carried out by the hotel/guest house at any time upon request. For larger conferences with image/sound/microphone support, the organizer is advised to call in an external technician for support. No reduction in costs can be derived in the event of technical faults or defects.
15. Fire safety regulations
The organizer undertakes to comply with the fire regulations of the hotel/guest house, in particular keeping escape routes clear, and guarantees that all materials brought in comply with fire regulations. The use of flammable objects is strictly prohibited.
16. Material delivery and collection
Deliveries and collections for events must be coordinated with the hotel/guest house and communicated to the hotel/guest house in writing as early as possible, at least before they arrive. The hotel/guest house reserves the right to reject shipments without a sender or valid addressee including information about the event. The hotel/guest house rejects any obligation or liability arising from this. Since the hotel/guest house's storage space is limited, the hotel/guest house can refuse to accept material before the day of the event.
When shipping from abroad to Lao PDR, customs and VAT are always charged in addition to the shipping costs. If the freight forwarder is unable to provide the exact costs upon delivery, we reserve the right to charge a flat rate of LAK 2,500,000 on the organizer's invoice.
17. Musical entertainment, shooting lesson and night surcharge
For events with music, please note that music is only permitted at room volume after 11 p.m. DJs and bands are required to keep the bass to a minimum and to cover the floor under the instruments with a carpet to reduce noise. The maximum playing time is until 2 a.m. For musical performances with a loudspeaker system outdoors, a permit must be applied for from the city police at least 4 months before the event. If the instructions are not followed, additional costs will be borne by the organizer. Copyright compensation in connection with musical performances must be clarified by the organizer themselves and will be at their expense.
If an event lasts longer than the legally permitted police closing time, a night surcharge must be paid. The extension of the closing time must be registered with the hotel/guest house at least 1 month before the event. The required police permit is obtained by the hotel/guest house and charged to the organizer.
From 11 p.m. onwards, windows and doors must be kept closed and the volume of the music must be reduced. Guests who are outside are asked to remain quiet. The instructions of the hotel/guest house staff must be followed. The organizer is liable for any complaints or fines.
Employees working at the event may be charged an additional hourly rate from 11 p.m.
18. Guest room
The “General Terms and Conditions for Room Bookings” apply to the booking of guest rooms. The following provisions apply in addition/deviating from them.
Breakfast is usually included in the room rate. Any deviations will be communicated in writing.
For events with overnight stays, the hotel/guest house will receive a room list from the organizer no later than 14 days before the arrival of the hotel/guest house guests, containing the following information on each guest: first and last names / arrival and departure dates / payment conditions.
In the case of a quota booking without a room list by the organizer, the hotel/guest house rooms must be booked directly by the guests and individually guaranteed using a valid credit card. After the deadline set by the hotel/guest house has expired, the rooms still available in the respective quota will be released for open sale. The organizer is liable in all cases for unpaid costs for the rooms booked by its guests and their consumption (no shows, minibar, etc.).
19. Liability / Duty of Care
The rooms and materials provided must be used with the utmost care by the guest. The organizer must always pay for any damage to property or loss that occurs. The hotel/guest house accepts no liability for theft, damage or in relation to services provided by third parties. This also applies to personal injuries, provided that these were not caused by employees of the hotel/guest house. The hotel/guest house is liable within the framework of the statutory provisions.
